DOE seeks interim ERC appointees

The Department of Energy has written the Office of the President to consider the possibility of appointing temporary commissioners in the Energy Regulatory Commission (ERC) to avoid a regulatory vacuum in the industry.

“Secretary (Alfonso) Cusi as energy secretary assures everybody that we are doing everything that we can to assure that there will be no power interruption. Secondly, the secretary wrote a letter to the Office of the President to look into the possibility of appointing temporary commissioners and look into this venue also,” Felix William Fuentebella, energy undersecretary, said in a briefing in Taguig.

“We also have a pending request with the Office of the President to put ERC under the administrative only supervision of the Department of Energy to ensure that what we are doing are all aligned,” Fuentebella added.

He explained that legal implications of the proposals are now being studied by the Office of the President, noting these may be allowed under the law.

“We have it under study since we have a principle in law that there should be no vacuum, the president has residual powers. Under the presidential system, in a way, the president is the strongest and if ever there is a vacuum, his residual power may be raised,” Fuentebella said.

He also mentioned that no names were suggested to fill in as temporary commissioners in the regulatory body.

With the present state of the ERC, Fuentebellasaid power supply agreements applied for by power distributors may be delayed but noted the implementation of the Renewable Power Source, Green Energy Option as well as the Retail Competition and Open Access may cushion the delays.

“We will have a little bit of delay but we assure whatever the secretary can do under his mandate that there will be no power interruption. The purpose why Secretary Cusi is pushing it is to explore all possibilities. We have to explore all steps since it’s a vital source. If we will not have enough, we will have problems,” Fuentebella said.

Last month, the Office of the Ombudsman ordered that graft charges be filed before the Sandiganbayan against dismissed ERC chairman and chief executive officer Jose Vicente Salazar, together with commissioners Gloria Victoria Yap-Taruc, Alfredo Non, Josefina Patricia Magpale-Asirit, and Geronimo Sta. Ana over alleged special favor granted to Manila Electric Co. and its affiliates.

The Office of the Ombudsman also placed all five ERC officials under suspension without pay for one year after finding them guilty of Conduct Prejudicial to the Best Interest of the Service as well as simple misconduct and simple neglect of duty.

For Salazar, who was already dismissed prior to the issuance of the Ombudsman’s directive, the penalty is converted to a fine equivalent to his six months’ salary.
