Missing P1,000-bill from P50M bribe irks Drilon

SENATE minority leader Franklin Drilon yesterday asked President Duterte to investigate the missing P1,000 bill from the P50 million that was surrendered by two former Bureau of Immigration officials involved in the bribery case of Chinese businessman Jack Lam.

Drilon said there was an obvious obstruction of justice over the missing P1,000, adding this would enable Michael Robles and Al Argosino to skirt possible plunder charges. Plunder is a non-bailable offense.

The missing P1,000 was revealed when Drilon on Tuesday night asked the status of the P50 million bribe money from Lam during the Senate deliberations on the proposed P17.43 billion budget of the Department of Justice.

Sen. Loren Legarda, chairman of the finance committee, with Justice Secretary Vitaliano Aguirre II sitting beside her, said the total amount returned was P49,999,000 and not P50 million.

Aguirre said P2 million was turned over to the Ombudsman; P18 million to the Criminal Investigation and Detection Group (CIDG), while P29,999,000 was turned over to the DOJ.

Drilon initially thought it was a joke, but when informed that it was the truth he sarcastically asked if the P1,000 was eaten by rats, noting that during his stint as DOJ secretary, drug evidence brought to courts go missing, supposedly eaten by rats.

Aguirre claimed the DOJ had no participation in the counting of the money, saying this was done by a bank.

But Drilon rejected Aguirre’s claims.

“You know, sir, we have this rule in evidence that the evidence must be consistent with the ordinary human experience. Isn’t it odd that the P50 million was reduced to P49 million? Incidentally P50 million is the threshold for plunder. I do not know who should conduct the investigation here. The sad part is, you can’t file plunder charges because you lost the P1,000,” said Drilon.

He stressed that when one asks for a bribe, “do you tell them make it P49,999,000 only? This is totally inconsistent with human experience”

“I do hope that the Ombudsman would see through heavens. I hope the Ombudsman would come up with the solution,” he said.

Asked who should conduct an investigation, Drilon said it is now up to President Duterte since the “DOJ is involved here.”

“There are people from the DOJ who were accused, so I don’t think the DOJ is the proper agency to investigate this,” he said. 

He called on the Office of the President to constitute an independent probe or the Ombudsman to conduct an independent probe as this is “very obvious amateur way of obstructing justice.”

Argosino and Robles received the supposed payoff from Lam in November last year reportedly to effect the release of 600 illegal Chinese workers employed by Lam at the Fontana casino in Clark.
