Partial list of documents on drug war submitted to SC

THE Office of the Solicitor General has submitted to the Supreme Court a partial list of documents related to the government’s anti-illegal drugs campaign, including case folders on over 30 persons killed in anti-drug operations.

The rest of the documents will be submitted in two months, with the PNP claiming it still needs to collect and validate them.

The SC directed the PNP twice – first on December 5, 2017 and again on April 3, 2018 – to submit documents related to government’s anti-illegal drugs war. 

In its compliance order dated April 26, the PNP, through the Solgen, said:  “The respondents need additional time to submit the other documents required by the Court because said documents will still be collected and validated.

“The respondents respectfully request an extension of 60 days from April 26, 2018, or until June 25, 2018 to submit the other documents required by this Honorable Court.” 

Among the documents the PNP has submitted are the case folders on the deaths of Ryan Dave Tuazon Almora, Rex Aparri, Conrado Berona III, Ryan Eder, Willie Ternora, Jerson Colaban, Joseph Baculi, Jossing Colaban, Emilio Blanco, Jerry Estreller, Delfin Sicson, Emil Morales, Eduardo Gores, Leo Geluz, Joshua Merced, Bimbo Merced, Ryan Dimacali, Reynaldo Javier Jr., Ramon Rodriguez, Paul Jhon Michael Enrera, Rolly Viros, Ronnie Viros, Crisanto Baquial, Ernesto Cruz, Elmer
Lagunsad, Paul John Martinez, Alvin John Mendoza, Gelber Begelme, SPO3 Dennis Padpad, Edwin Eduardo De Gracia, Jeffrey Degala, Manuel Roy Manalac and the case folder on the injury sustained by Jefferson Soriano.

Also submitted to the SC were the copy of Oplan Double Barrel Alpha, statistics on PNP cleansing, list of arrested Chinese and Filipino-Chinese from 2003 to 2017 for their alleged involvement in illegal drugs, number of buy-bust incidents in San Andres Bukid, Manila from July 2016 to November 2017, drug watchlists in Sta. Ana, Manila, summary of administrative cases on PNP personnel in various regions of the country conducting anti-drug operations;

PNP investigations on anti-drug operations under Oplan Double Barrel from July 2016 to December 2017, pronouncement of President Duterte to get rid of illegal drugs, copy of the memorandum regarding the implementation of the National Anti-Drug Action Plan, resolution approving the creation of the PNP-Anti Illegal Drugs Group as a national support unit of the police and the memorandum for the revitalization of the Barangay Anti-Drug Abuse Council.

The PNP also submitted a copy of its manual on anti-illegal drugs operations, a copy of the US State Department Diplomacy in Action Country report, the board regulation of the Dangerous Drugs Board in the implementation of anti-drugs operations, the Napolcom memorandum directing the PNP to conduct intensified anti-drug campaign, DDB regulation on the revised guideline in the conduct of barangay anti-drug clearing operations and a copy of the Executive Order strengthening the support mechanism for the Philippine Drug Enforcement Agency.

In its original order last December, the SC directed Solicitor General Jose Calida to submit within 60 days documents, including the list of persons killed in legitimate police operations from July 1, 2016 to November 30, 2017, list of deaths under investigation from July 1, 2016 to November 30, 2017, list of Chinese and Filipino-Chinese drug lords who have been neutralized, list of drugs involved whether shabu, cocaine, marijuana, opioids, etc., comparative tables in index crimes, statistics of internal cleansing within the police force and drug watchlists in affected areas.

The SC also directed the OSG to submit the list of warrants and warrantless arrests in High Value Target police operations and the list of cases under investigation under the PNP Internal Affairs Service.

The original order was issued by the SC after it concluded the oral arguments on the petitions filed by the Center for International Law (CenterLaw) and the Free Legal Assistance Group questioning the legal basis of the government’s anti-drug war.

Calida appealed the SC order, citing risks to national security, adding it might put at risk the lives of informants who provide information in the ongoing anti-drug war.

He also said the right to information, including rights to official records, is not absolute and that the Constitution provides that the people’s right to know is limited to “matters of public concern.”

But the SC,  in an order issued last month, dismissed Calida’s motion saying the information and documents related to the government’s anti-drug campaign that it directed the PNP to submit will not compromise the country’s national security contrary.
